Mark Alias writes in Democracy Docket, that the case coming under consideration by the Supreme Court “could shake the foundations of federalism and judicial review and undermine the tools available to protect future elections.” The case sees North Carolina Republicans advancing the Independent State Legislature (ISL) theory, which would limit state courts’ ability to interpret their own state’s laws, and may give state legislatures the exclusive power to set the “manner” of choosing presidential electors, among other things.
