As Rachel Cleetus explains in Scientific American, the Court’s decision in West Virginia et al. v. Environmental Protection Agency et al. actually cuts against the logic of utilities themselves, who are increasingly viewing lower-emitting energy technologies as the future of the industry and have voiced support for emissions regulations:
This decision wrongfully precludes the agency’s authority to set robust power plant carbon pollution standards in line with today’s technologies and practices adopted on a sector-wide basis. In fact, utilities are increasingly turning to these options—although not fast enough—and many had weighed in in support of EPA power plant carbon standards.
